1.Welcome to Coach Falco

Welcome to Coach Falco!

We believe tennis and padel should be enjoyable, rewarding and accessible. Whether you're learning the basics, developing your technique, building confidence or competing at a higher level, we're delighted to be part of your sporting journey.

These Terms of Business explain how we work together, what you can expect from us and the responsibilities that help everyone enjoy sport safely and fairly.

2.Who we are

Coach Falco is the trading name of Falco Niekoop-Bird, an independent sole trader operating in England.

Falco is an LTA Level 2 Accredited Coach. Awaiting confirmation

The Newbury Tennis Club address is used for correspondence only. The club does not own or operate Coach Falco.

References to "Coach Falco", "we", "us" and "our" mean Falco Niekoop-Bird trading as Coach Falco.

3.Our services

Coach Falco is developing an international tennis, padel, sporting education and lifestyle platform. Our activities may include:

• Individual tennis coaching at venues in Staffordshire, Oxfordshire and Berkshire, England
• Group coaching and player development
• Junior coaching
• Corporate coaching and sporting events
• Tennis camps, clinics and organised trips
• Worldwide virtual tennis coaching and video analysis
• Personalised written coaching advice
• Tennis and padel educational content
• Talking Tennis podcast and interviews
• Sporting partnerships and collaborations
• Future equipment, clothing and sporting product retail

Some activities are planned for future introduction and may not currently be available.

We will explain the specific arrangements for a service before accepting a paid booking.

4.Enquiries and bookings

Submitting an enquiry does not automatically create a booking.

A booking is confirmed when Coach Falco accepts it and sends you a booking confirmation setting out the service, date, location or delivery method, price, payment terms, cancellation terms and any additional conditions.

Availability may depend on coaching schedules, suitable facilities, weather and other operational considerations.

Please make sure the information you give us is accurate, and tell us promptly if relevant circumstances change.

5.Prices and payments

Prices will be communicated before a paid service is confirmed.

Any advance payments, deposits, venue fees or other charges will be set out in your booking confirmation before they become payable.

Prices may change for future bookings, but we will not change the price of a confirmed booking without your agreement.

Where invoices are issued, payment should be made according to the agreed terms.

6.Cancellations and rearrangements

We understand that plans sometimes change. Please tell us as early as possible if you need to cancel or rearrange a booking.

Your booking confirmation will set out the cancellation notice period and any refund or rearrangement terms that apply. We will not apply any cancellation charge that was not made clear to you before you booked.

Bookings made online, by phone or by email. If you are a consumer, you will normally have 14 days from the date your booking is confirmed to cancel and receive a full refund. If you ask us to start the service within those 14 days and then cancel, we may deduct a proportionate amount for the service already provided. Once a service has been fully provided at your request, this cancellation right ends. Some services booked for a specific date may not carry this right; if so, we will tell you before you book.

Where statutory consumer rights give you more protection than these Terms, those rights apply.

7.Weather, venues and unavoidable disruption

Outdoor tennis and padel depend on suitable playing conditions.

Coach Falco may postpone, adapt or cancel an activity if courts are unsafe, weather conditions are unsuitable, a coach becomes unavailable or circumstances outside our reasonable control prevent safe delivery.

Where Coach Falco cannot provide a paid service, we will offer you a rearrangement or a refund in line with your booking confirmation and applicable law.

8.Health, fitness and medical considerations

Your health and wellbeing come first.

Tennis, padel and associated training involve physical exertion. Participation may involve risks such as falls, collisions, muscular or joint injuries, dehydration, heat-related illness and cardiovascular events.

Please consider your health, fitness, experience and ability before taking part.

Please tell Coach Falco privately, before participating, about any medical condition, injury, disability or health concern that could affect safe participation or require an adjustment. Relevant matters may include:

• High blood pressure or cardiovascular disease
• Previous stroke or other significant cardiovascular events
• Chest pain, unexplained breathlessness or fainting
• Diabetes or conditions affecting blood sugar
• Respiratory conditions
• Recent surgery, injury or rehabilitation
• Musculoskeletal or mobility difficulties
• Pregnancy-related exercise restrictions
• Any medical advice limiting physical activity

Having a medical condition does not automatically exclude anyone from coaching. Where appropriate, please seek advice or clearance from a qualified healthcare professional before undertaking physical activity.

Coach Falco may reasonably request medical clearance, adapt an activity or decline participation where there are significant safety concerns.

Please do not exercise while unwell or experiencing symptoms that make activity unsafe.

Stop immediately and tell the coach if you experience chest pain, severe or unusual breathlessness, dizziness, faintness, a sudden severe headache, weakness or other concerning symptoms.

Coach Falco provides sporting coaching, not medical diagnosis, treatment or rehabilitation.

9.Participant responsibilities

Participants are expected to:

• Follow reasonable coaching and safety instructions
• Wear suitable footwear and clothing
• Use appropriate equipment
• Remain adequately hydrated
• Respect other players and court users
• Avoid participating while impaired by alcohol or drugs
• Report hazards, injuries or concerning symptoms promptly
• Work within their capabilities and say when a drill feels unsafe

Coach Falco may stop or modify an activity where reasonably necessary to protect participants.

10.Sporting risks and liability

Sport involves inherent risks even when sensible precautions are taken.

Coach Falco will provide coaching and related services with reasonable care and skill.

We cannot guarantee that participation will be entirely risk-free, or that a particular competitive, fitness or performance result will be achieved.

Participants are responsible for following reasonable instructions and raising any safety concerns.

Business customers. If you book as a business (for example, a corporate coaching day or event), our total liability to you in connection with that booking is limited to the price paid for it, and we are not liable for loss of profit, loss of business or other indirect or consequential loss.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.

Nothing in these Terms affects your statutory rights as a consumer.

11.Junior coaching and safeguarding

Children and young people are welcome in appropriate Coach Falco activities.

A parent or legal guardian must provide the necessary authorisation and contact information.

Parents and guardians should tell us about any needs or circumstances affecting a child's safety.

Arrangements for supervision, arrival, collection and communication will be confirmed for each activity.

Coach Falco is committed to appropriate safeguarding practices, respectful conduct and the welfare of children and vulnerable participants.

Any safeguarding concern should be reported promptly using the contact details provided for the activity.

Separate arrangements may apply to junior photography and filming (see section 18).

12.Behaviour and respect

We want Coach Falco activities to be positive, inclusive and enjoyable.

Bullying, harassment, discrimination, threatening behaviour, deliberate damage and unsafe conduct are not acceptable.

We may take proportionate action, including ending participation, where reasonably necessary to protect people or property. Any refund will be considered fairly and in line with applicable law.

13.Coaching locations and facilities

Private in-person coaching is offered at venues in Staffordshire, Oxfordshire and Berkshire, England, by arrangement and subject to availability and suitable facilities. The venue for each session will be confirmed in your booking confirmation.

Other activities, events or trips may take place at different locations by prior arrangement.

Participants must comply with reasonable venue rules and safety requirements. Where an independent venue or organiser provides separate services, their own terms may also apply.

14.Coaching provided through other organisations

Falco also coaches on behalf of other organisations, such as tennis centres, academies and clubs.

Sessions booked through those organisations are provided by them, under their own terms, and are not Coach Falco bookings.

These Terms apply only to services booked directly with Coach Falco.

Private one-to-one coaching that you arrange directly with Falco is a Coach Falco booking, even where the session takes place at an NTA venue or another club's facilities. It is arranged and paid for directly between you and Falco, trading as Coach Falco. The venue does not manage that private booking or collect the coaching fee, although its own facility-use rules and conditions may still apply.

NTA group programmes are separate and are provided under the applicable NTA programme terms, not these Terms.

15.Worldwide virtual coaching and video analysis

Coach Falco may provide personalised coaching to clients internationally by reviewing submitted tennis footage.

You are responsible for submitting only footage you are entitled to share. Where footage shows other identifiable people, please make sure you have their permission or avoid unnecessary disclosure.

You keep your rights in your original recordings. By submitting material for a requested coaching service, you give Coach Falco permission to access, store, analyse and annotate it for the purpose of delivering that service.

Private coaching footage will not be used in public promotional content without your separate permission.

Virtual coaching is based on the footage and information supplied and cannot replicate every aspect of an in-person assessment. Please take appropriate care when practising coaching recommendations on your own.

Fees, delivery times and any follow-up arrangements will be confirmed before purchase.

16.Written coaching advice

Coach Falco may provide personalised written feedback on technique, tactics, preparation, equipment and other sporting subjects.

Recommendations are educational and based on the information provided. They are not a substitute for medical, physiotherapy or other regulated professional advice.

17.Groups, camps, corporate events and international trips

Group activities, camps, clinics, corporate events and international coaching trips may have additional terms covering:

• Eligibility and minimum participant numbers
• Programme content and coaching arrangements
• Accommodation and travel responsibilities
• Insurance and emergency contacts
• Payments and cancellation conditions
• Local laws and venue requirements
• Health and safety considerations

These additional terms will be provided before you book.

Trips that include travel or accommodation will only be offered once the arrangements meet applicable travel regulations, including any required financial protection.

18.Photography, filming and audio recording

Coach Falco may arrange photography, filming or audio recording at coaching sessions, events, interviews and other activities.

Where identifiable images or recordings are intended for promotional use, we will explain the intended purposes and obtain appropriate permission where required. Potential uses may include:

• The Coach Falco website
• Official social media channels
• Sporting and educational content
• Editorial articles and interviews
• Talking Tennis
• Advertising and promotional campaigns
• Approved brand collaborations

Attending an activity does not give Coach Falco unrestricted promotional rights over your image.

Where we rely on consent, you may decline optional promotional photography without losing access to ordinary coaching. Separate parental or guardian permission will be sought for children.

If you are concerned about an image or recording, contact us and ask for it to be reviewed, removed or obscured. We will respond appropriately, taking account of applicable rights and what remains within our control. Printed materials and copies shared independently by third parties may not always be fully retrievable.

19.Intellectual property

The Coach Falco name, falcon identity, original coaching resources, written content, designs, photographs and other protected materials belong to Coach Falco or their respective rights holders.

Content may not be reproduced, sold or commercially exploited without permission.

You may use coaching materials supplied to you for your own personal development unless otherwise agreed.

20.Talking Tennis and editorial content

Podcast interviews, articles, commentary and educational resources are intended for information, discussion and sporting enjoyment.

Opinions expressed by guests are their own.

General content is not a substitute for personalised coaching, medical advice or other professional services.

21.Future online shop

Coach Falco intends to develop a retail offering featuring tennis, padel and related sporting products.

Before any products are offered for sale, we will publish separate terms covering product descriptions, prices, payment, delivery, returns, refunds, warranties and any international restrictions.

22.Partnerships and third parties

Coach Falco may collaborate with sporting clubs, brands, suppliers, sponsors, media organisations and other businesses. Such relationships may be subject to separate agreements.

References or links to third parties do not constitute a guarantee or endorsement of their products or services.

23.Personal information

We handle personal information in line with our Privacy Policy.

Health information, children's information and private coaching footage require particular care. They will not be used for unrelated marketing purposes without an appropriate lawful basis.

24.Complaints and resolving concerns

We want everyone to have a positive experience. If you have a concern about a service, please contact us and explain what happened.

We will consider complaints fairly and seek a reasonable resolution.

Nothing in these Terms prevents consumers from exercising their legal rights or seeking an available remedy.

25.General

Your agreement with us. Each booking is governed by these Terms together with your booking confirmation. If they conflict, the booking confirmation applies, except where that would reduce your statutory rights.

If part of these Terms is invalid. If any part of these Terms is found to be invalid or unenforceable, the rest will continue to apply.

Third parties. These Terms are between you and Coach Falco. No other person has any right to enforce them.

26.Changes, governing law and contact

We may update these Terms as our business develops. For confirmed bookings, the Terms in place when the booking was made will continue to apply unless a change is required by law or agreed with you.

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
